Eligibility

The Site is a public website open to general visitors. Participation in particular purchases, reservations, promotions, or programs offered through the Site may be subject to additional eligibility requirements set forth in the terms applicable to that purchase, reservation, promotion, or program. For example, participation in the current $8.30 reservation program is limited to individuals 18 years of age or older, as set forth in the Reservation Terms.

Changes to the Site and These Terms

We reserve the right to update or modify these Terms at any time, with or without prior notice. Changes become effective upon posting to the Site. We will update the "Last updated" date at the top of this page when changes are made. Your continued use of the Site after any change constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

We may also change, suspend, or discontinue any part of the Site at any time in our sole discretion, with or without notice. We are not liable if all or any part of the Site is unavailable at any time or for any period.

Reservation and Early-Access Programs

From time to time, 8:30 Beauty may offer reservation or early-access programs through the Site. Participation in any such program is governed by the separate terms applicable to that program (such as the Reservation Terms), which are incorporated into these Terms by reference. In the event of a conflict between these Terms and the terms of a specific program with respect to that program, the program-specific terms control.

Intellectual Property

The Site and its entire contents, features, and functionality — including but not limited to text, graphics, logos, images, and the selection and arrangement thereof — are owned by 830 Beauty, LLC or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Site without our prior written consent, except as follows:

• Your device may temporarily store copies of materials incidental to your accessing and viewing those materials.
• You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use, provided you do not modify the materials and you retain any copyright or other proprietary notices.

No right, title, or interest in or to the Site or any content on the Site is transferred to you, and all rights not expressly granted are reserved by 8:30 Beauty.

Prohibited Uses

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates any applicable federal, state, local, or international law or regulation.
• Transmit any unsolicited or unauthorized advertising or promotional material.

• Use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission.
• Introduce any viruses, trojan horses, worms, or other material that is malicious or technologically harmful.
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site, or that may harm 8:30 Beauty or users of the Site.

THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, 8:30 BEAUTY DISCLAIMS ALL WARRANTIES OF ANY KIND WITH RESPECT TO THE SITE AND ITS CONTENT, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 8:30 BEAUTY DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, 8:30 BEAUTY, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE OR ITS CONTENT.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. TO THE EXTENT SUCH LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or related to them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Texas, without giving effect to any choice or conflict of law provision or rule. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Texas, and you hereby consent to personal jurisdiction and venue in those courts.
